'Killer cop' remains in jail!

"KILLER" cop Detective Sergeant Monday Ximondzo Ngobeni (43) will remain in jail until Monday, 31 July, for judgment on his bail application.

This follows his third appearance in the Bushbuckridge Magistrates Court in Mpumalanga on Wednesday, 12 July, for his bail bid.

During heads of arguments before Magistrate Charles Makgotho, Ngobeni's defence lawyer Willies Shabangu challenged the strength of the matter, saying his client be given bail as the state couldn't prove that he premeditated his lover Agnes Maluleke's murder.

"The submission by investigating officer didn't offer any evidence that my client premeditated the murder of his girlfriend," he said.

He maintained that the investigator's evidence was baseless and that his client knew the witness.

"This matter falls under schedule 55, so my client's resignation from work doesn't mean he wanted to evade his trial anyway," he said.

But public prosecutor Lot Mgiba said: "This is a schedule six offence. The bail application is opposed.

"The accused is guilty of murder which was well-planned or premeditated. The evidence before the court is that on the day in question, the accused was overheard by a witness saying, 'I am going to shoot the deceased'.

"After those words, there's evidence that the accused unzipped his jacket and fired a shot at the deceased as she tried to run away, but she fell. But that's not enough for him. The accused continued to follow her and shot her twice to ensure she was dead. So, the state has a strong case against him." 

Mgiba said that the accused is a police detective who is aware that once he's convicted, he will get a heavy sentence.
