SHAVANI'S APPEAL WAS DISMISSED!

THE FACTS

RENDANI Phophi from Mogale City, Gauteng said his brother Shavani Phophi had appealed against his court conviction and sentence but that he was still behind bars, serving time.

Rendani contacted SunDefender and asked for help.

WHAT I DID

I read the order issued by the judge who had heard the appeal.

SOLUTION

Shavani saw on the order that it stated “the appeal against the convictions and sentences is dismissed.”

He mistakenly thought it meant that the conviction and sentence had been dismissed.

What the judge had in fact stated was that there were no grounds on which he should be released from prison and that his appeal had failed.
