THE FACTS

MSEZANE Halalisani from Freedom Park, Soweto said he was employed by Epic Foods. In July the management told them they should not report for duty until further notice. After two weeks they found out the company had employed casual workers. They reported their case to the CCMA and won the case and were advised to return to work. The others were called back, but Msezane was told he could not come back because he was a troublemaker.

WHAT I DID

I spoke to Scorpion Legal Protection to find out what Msezane could do.

SOLUTION

Msezane needs to go back to the CCMA to have the signed settlement agreement turned into an award and thereafter certified. Then the agreement can be enforced so he can be reinstated.
