THE FACTS
Jonas Molekoa from Tembisa, near Midrand, Gauteng was bitten by a lion at the Lion Park while working for Moreba Tours.
The park paid for his hospital bills but now he can’t apply for his compensation fund because he says his employer won’t complete the necessary forms, as required by the compensation fund.
He went to the Labour Department at Kempton Park but found the owner was not registered.
The owner was ordered to register the company but they still didn’t send the necessary documents, specifically mentioning that he was on duty when he was attacked by the lion.
WHAT I DID
I spoke to Scorpion Legal Protection to find out what can be done to help Jonas.
SOLUTION
The employer is non-compliant with the Compensation for Occupational Injuries and Diseases Act.
He needs to provide for compensation for disablement caused by occupational injuries or diseases sustained or contracted by the employee so the employee can be compensated.
Jonas must go to the department of labour and ask for an investigation. The employer is required by law to report the accident within seven days on the prescribed WLC2 form, notifying the compensation commissioner of the accident, and the form must be submitted to the department. If the employer fails to do this, he may be guilty of a criminal offence.
