THE Supreme Court of Appeal (SCA) has granted Dr Nandipha Magudumana leave to appeal a Bloemfontein High Court's decision to dismiss her application to declare her repatriation from Tanzania unlawful.
Daily Sun has learnt that SCA has granted Magudumana this opportunity to fight back on Wednesday, 25 October.
This after the High Court dismissed Magudumana's application twice following intensive submissions between the defence and lawyers of the minister of Home Affairs, the Directorate of Public Prosecution, Department of Correctional Services as well as the Ministry of Police.
Magudumana's lawyers had argued that her apprehension and subsequent deportation were unlawful and their clients was subjected to a toxic extradition.
The state prosecutor had submitted during Magudumana's bail hearing that she had voluntarily requested to be brought back to reunite with her children.

Magudumana was arrested alongside her notorious boyfriend, convicted rapist and murderer Thabo Bester, in Tanzania in April after the two fled the country. She was found in possession of two passports, which she never used when she crossed the borders.
Magudumana hasn't given up regardless of losing two High Court appeals. Magudumana forms part of the accused in the Bester prison escape case that was recently transferred to the High Court.
She was discribed a mastermind in the Thabo Bester dramatic escape from Mangaung Correctional centre in May 2022.
The date of Supreme court of appeal debate is yet to be announced.
