SUSPECTS accused of burning and killing seven people in a mob attack in Diepsloot, north of Joburg earlier in December 2023 deny being involved in the gruesome crime.
The five men facing charges of murder, attempted murder, kidnapping, grievous bodily harm, and immigration act appeared in the Randburg Magistrates Court on Monday, 18 December for a bail application.
The lawyer representing accused one, two, and five Jimmy Baloyi, told the court that his clients were not even part of the mob that killed the seven, therefore, they should be given bail.
Briefing the media after the adjournment, Baloyi said there was no evidence against the accused.
“There's no evidence against my clients at this stage that the State has put forward to warrant them being kept in custody we intend to fully deal with this matter once it appears for trial,” he said.

Baloyi said there was progress on the case.
“Today we have made progress, I wouldn't want to go to the merits of the case, and we are hopeful that tomorrow we will finalize the case."
Baloyi admits they haven't seen the charge sheet.
“We haven't formally given the charge sheet. It is the charge sheet indictment that can eventually tell us how many charges my clients are facing. We hear from the State that there is murder, kidnapping, and attempted murder.”
The suspects can't be identified at this stage.
Diepsloot community and family members continue to support the suspects.
The bail hearing for accused three and four will be heard on Tuesday, 19 December.
