CONTROVERSIAL Dr Nandipha Magudumana lost her bid to appeal in the Free State High Court on Tuesday, 18 July.

Magudumana was challenging her arrest and subsequent extradition from Tanzania to South Africa to be unlawful.

She has lost her highly anticipated leave to appeal, which has been tracking for weeks.

The State has argued that Magudumana contested to be brought back to South Africa after being arrested by Tanzania authorities towards the Kenya border port of entry.

Judge Philip Loubser has dismissed Magudumana's leave for appeal with cost for the second time.

This after Magudumana's legal team filed an application for leave to appeal after the High Court dismissed with costs her application to declare her arrest in Tanzania unlawful.

Judge Loubser found that during her arrest, proper procedures were not followed but dismissed it on the basis that she volunteered herself to be brought back to South Africa, claiming that she wanted to be with her children.

Magudumana's legal team contested that Home Affairs Minister Dr Aaron Motsoaledi and the police ignored international law for deporting their clients in a disguised extradition.

She is accused number four on the list of 12 people arrested regarding the Thabo Bester's mysterious escape from the Mangaung Correctional Centre in Bloemfontein, Free State in May 2022.

She is among her lover Bester, a Zimbabwean national Zanda Moyo, Moeketsi Ramolula, and Motanyane Masukela, who are still in jail, while others, including accused number one Senohe Matsoara, Teboho Lipholo, Tieho Makhotsa, Thabang Mier, Joel Makhetha, Zolile Sekeleni and Natassja Jansen are out on R10 000 bail each.

Magudumana and her notorious Facebook rapist and murderer, Thabo Bester, have since reserved their rights to apply for a bail in the Bloemfontein Magistrates Court.

All the accused in the Bester's dramatic escape from the Mangaung Correctional Centre will be back in court on Tuesday, 08 August.
