IT is still not clear whether the controversial Dr Nandipha Magudumana was unlawfully arrested and deported from Tanzania to South Africa in April 2023.
On Friday, 14 July, Magudumana’s legal representatives had a second chance to convince the Free State High Court that the arrest and extradition be declared unlawful.
Her first application was dismissed by Judge Phillip Loubser, on the basis that she told authorities in Tanzania that she wanted to reunite with her kids in Mzansi.

At the time of her arrest, Magudumana was on the run with her boyfriend, Thabo Bester, when they were both arrested in Tanzania. This after a warrant of arrest was issued for Bester following his dramatic escape from the Mangaung Correctional Centre, Free State in May 2022.
Loubser considered that Magudumana's process of deportation was an extradition with no proper lawful element, but also stressed that she voluntarily participated and showed her wish to return to South Africa to reunite with her children.
Her legal team has the strong belief that the Supreme Court of Appeal can come up with a different judgment in favour of their client.
Magudumana is one of 12 accused who were bust for helping a convicted prisoner escape from lawful custody.
Loubser announced that the judgment in Magudumana's matter would be delivered on Tuesday, 18 July.
