Oscar Pistorius could be a free man again

THE Constitutional Court has confirmed convicted murderer Oscar Pistorius is eligible for parole.

According to ConCourt, the paralympian has been eligible for parole since March this year. This comes after Pistorius approached the court for his parole application.

According to the SABC, in the papers filed before the apex court by Pistorius, he requested a direct access, which was granted, for clarity on the November 2017 order of the Supreme Court of Appeal (SCA), which overturned his six-year sentence of culpable homicide to 13 years and 5 months for a murder charge.

The sentence given by the SCA also considered that Pistorius had already served a period of jail time.  

“Papers reveal, however, that in March 2023, the SCA issued a communique before the sitting of his parole hearing that the sentence of the November 2017 order is effective from 24 November 2017,” reported SABC.

Responding to the ConCourt clarification, the Department of Correctional Services said it has received an order from the Constitutional Court on the proper interpretation of the Supreme Court of Appeal’s Judgement delivered on 24 November 2017.

“Briefly, the matter relates to the sentence given to inmate Oscar Leonard Pistorius, its effective date and the impact on the calculation of the minimum detention period.”

“DCS is studying the order and shall in due course pronounce itself on the way forward. This shall ensure that the order of court is correctly executed,” said department spokesman Singabakho Nxumalo. 

Pistorius is currently serving time for the murder of his girlfriend, model Reeva Steenkamp, which he committed in 2013.
