THE Rustenburg Magistrates Court postponed the murder case against Sibongiseni Ngubane (33) on Tuesday, 19 September.
Sibongiseni was arrested on 12 September in Germiston for the murder of famous businessman, Ben Gumbi.
The case was postponed to 27 September for the continuation of bail proceedings and consultation.
Ngubane’s attorney read an affidavit in court citing reasons for him to be granted bail.
The state strongly opposed the granting of bail, to which the investigating officer was called to the stand to cite reasons for opposing.
Amongst other reasons cited by the investigating officer, was the seriousness of the offence as the accused was pointed out at an identity parade by several witnesses.
Colonel Patrick Morunwa, who is the Investigating Officer, said the accused would not be safe, stating that the accused revealed that the other assailants were dangerous and would kill him.
Morunwa said they traced the accused from the fingertips on the VW Polo car that the gunmen left behind after the incident.

"The accused has three pending cases which include robbery and two cases where he was found in possession of an unlicensed firearm and ammunition," said Morunwa.
Morunwa further revealed that the jeans and black shoes he was wearing on the day of the arrest were the same as the ones that appeared on the CCTV footage.
He said the accused revealed that he was paid R15,000 stating that he was called by someone who was the one hired to kill Gumbi.
The deceased’s son, Ntokozo Gumbi, said it is still very painful for the family as they have lost a breadwinner.
“We are however happy for the breakthrough. We wish the accused can tell the truth so that everyone involved is arrested," said Ntokozo.
