THE north Gauteng High Court, hearing the former Bafana Bafana goalkeeper Senzo Meyiwa murder case, has ruled that confessions by Muzi Sibiya and Bongani Ntanzi were made freely and will be admitted as evidence in the main trial.
When Judge Ratha Mokgoatlheng read the judgment, he said he considered whether evidence provided during a trial-within-a-trial was admissible, or not.
“I've dealt with all evidence relating to whether the said alleged confession was made freely and voluntarily in the sound and sober senses of the deponents without any force or coercion.
"I’ve dealt with all that, and I’ve also dealt with other primary defences by the accused that all the accused were not appraised of their constitutional right,” he said.

The judge said the confessions were made freely by the accused.
“This court has reached the following conclusion: Accused number one was in his firm, sound, and sober senses. To the confession made by accused number two, in the spirit of the same confession…it was made freely and voluntarily, without any coercion.”
The trial-within-a-trial, which began in October 2023, was to find out if evidence presented could be used in the main trial.
The two accused are among the five men who are charged with the murder of former Orlando Pirates captain in 2014 in Vosloorus, Ekurhuleni, when he visited his then-girlfriend and singer Kelly Khumalo.
