THE African National Congress (ANC) said it will appeal the judgment of the High Court in Durban, which dismissed with costs the governing party's application to challenge the uMkhonto Wesizwe (MK) party’s name and logo.
The ANC accused the MK of violating the Trademark Act by using a name and logo similar to the ruling party’s disbanded uMkhonto weSizwe military wing.
Following the judgment, ANC secretary-general Fikile Mbalula addressed the media at Luthuli House in Joburg on Monday, 22 April.
"The Zuma party is misrepresenting itself as being connected or associated with the ANC by using our well-known logo on its well-known uMkhonto Wesizwe," Mbalula said.

He said when appealing the judgment, the ANC will question whether the unauthorised use of one's intellectual property consists of what and how the unauthorised party uses it.
However, MK party Jabulani Khumalo urged the ANC to accept defeat and move on.
“They can appeal as many times as they want, but we will still win it because they have no facts. They were just trying to prevent us from winning the elections," he said.
Khumalo said they had expected this ruling.
"We were expecting this. We don't know why the judge kept it this long because they knew that we had already won. From here, we're going to the ground to mobilise people so that we get the two-thirds majority," he said.
