ANC sends Sheriff packing!

THE ANC says it has successfully stopped Ezulweni Investments, which it owes R102 million, from seizing its assets.

This comes after the marketing company sent the sheriff to seize the party's assets on Monday morning, 4 December 2023.

Last month, the Supreme Court of Appeal dismissed ANC’s case that it did not owe Ezulweni Investments millions of rands for unpaid services rendered in connection with the 2019 national elections campaign. 

The Sheriff of the High Court arrived at the ANC Headquarters, Luthuli House, in the Joburg CBD on Monday morning but the security turned them away without taking any assets.

After more than five hours of waiting for the ANC to response to media queries, its party spokeswoman Mahlengi Bhengu-Motsiri held an urgent media briefing, where she said the party’s lawyers "had appealed the decision of the Supreme Court of Appeal (SCA) in the Ezulweni matter in the Constitutional Court of South Africa".

Following the unfavourable judgment by the Supreme Court of Appeal, the party indicated and made its communication last week that it had now taken the matter to the Constitutional Court "which in fact postpones execution of the SCA decision in accordance with relevant legislations,” she said.

“The ANC finds it curious that despite our legal team communicating with their legal counterpart in Ezulweni Investments to stay the application of the matter pending the appeal, failed attempts were made to proceed with the attachment order,” she said.

She also alleged the company was playing to the gallery of the media because they had written to the lawyers on Friday, 1 December.

“We can only conclude that this is an attempt to create a spectacle when none is unwarranted,” she said.

Bhengu-Motsiri said the party had money to settle the debt if need be but they still exercised the court avenue.

“The ANC has the money. We have the money to settle if we have to in this matter, but we are not settling on this matter. We are exercising our right to approach the highest court in the land.”
