Basetsana Kumalo still fighting for justice

AUTHOR and social activist Jackie Phamotse is still waiting to be sentenced.

The 34-year-old Joburg-based author made a brief appearance in the Randburg Magistrates Court on Tuesday, 5 March.

The case was postponed to 26 March for sentencing.

During the court proceedings, Basetsana Kumalo said her soul was tired and that it was an emotional ruling for her during the cross-examination.

The media personality said she still wants justice even after so many years.

"Your worship, my soul is tired. I've been coming here since 2018. My family went through the most for the past six years. Your worship, I was raised well in a Christian home with values," Basetsana said.


State prosecutor Yousuf Baba said this must serve as a lesson, and Phamotse must know the consequences of her actions.

"I want us to continue with this particular matter. I would like us to stop using the newspaper article for now. How many paragraphs are talking about the victim? Does the accused consider herself as a victim?" he asked.

Baba said Phamotse was ordered by the court several times to remove her tweets, but she didn't. 

Probation officer Xoliswa Budaza from Gauteng Department of Social Services said she appeals that Phamotse gets a lighter sentence.

"Yes, from what I read she considers herself as a victim. The case had a huge impact on her as she was no longer invited to events or seminars. She has also indicated how her family has suffered during this matter in court. Her words were that she is remorseful and wanted to help people who are bullied on social media platforms," said Budaza. 

Phamotse's attorney, Mpho Mathonsi, said he gets shocked when they bring witnesses.

"My colleague wants the social worker to comment on some of the matters she doesn’t know. This is unfair on the social worker," he said.

He said the accused has suffered a lot in this industry and her family as well.

Magistrate S Naidoo asked Budaza if she sees Phamotse as a remorseful person.

"How did you come to the conclusion that Miss Phamotse is self-aware? In your report you said you want her to get a better sentence," said the magistrate.

Budaza recommended a fine based on Phamotse's contributions to communities and her expression of remorse.

Phamotse was previously found guilty of defamation against media personalities Basetsana and Romeo Kumalo, resulting in charges of crimen injuria, defamation, and contempt of court.
