ACCUSED number five in the AKA and Tibz murder, Lindokuhle Ndimande, has denied being a spotter.
However, he agreed that he was at the Wish Restaurant on Florida Road in Durban, waiting for his girlfriend who never showed up.
Ndimande (29) was responding to the affidavit of investigating officer Detective Bob Pillay on Tuesday, 2 April in the Durban Magistrates Court.
Pillay's affidavit, where he was opposing the bail application of the five accused, was read out in the court on Wednesday, 27 March.
Pillay revealed that Ndimande, as the alleged spotter, positioned himself at the restaurant where AKA and Tibz were shot dead on 10 February 2023.
He further said Ndimande paid for his food and drinks using his new Standard Bank card which he had opened on the same day.
Ndimande said on the day of the incident, he had arranged to meet a woman at Wish Restaurant.
“I, however, realising that the clock was ticking while at Wish Restaurant and the lady was not coming, I kept calling her and she kept on promising that she'd definitely come.
“I dispute any notion that I was a spotter as I was not even aware that the first deceased was also around. It was shortly after the gunshot had seized that I heard that there was a shooting outside and that one of the victims was Mr AKA. I didn't know anything about the shooting,” he said.

He also denied the investigation officer’s version that he had changed positions while at Wish Restaurant. He also disputed the investigating officer’s version that he wasn't a regular patron at Wish Restaurant.
“Prior to the 10th of February 2023, I used to have personal Discovery and Time Bank cards. Due to problems with these cards, applicant four (Mziwethemba Gwabeni) used to deposit money after I worked as his driver, especially with long distance trips, into my brother’s bank and my brother is Sifundo Ndimande but known as DSD.
“Coincidentally, I approached Standard Bank to open a bank account on the 10th of February 2023. I don’t dispute that I was paid. It was for work I rendered without being paid over a period of time, that time I was eventually paid R100 000 by the fourth applicant,” he said.
The case was postponed to Monday, 8 April, where accused number two and four will also respond to the investigating officer’s affidavit.
