THE FACTS

THEMBA Thekiso from Kagiso, Mogale City, believes the company he works for doesn’t treat its employees fairly.

He wanted to know if they could choose and join a union.

He asked whether it’s legal for the company to ask them to stay home during lockdown and be paid partially.

He wanted to know if an employer can enter into an agreement with the union or even dismiss employees without warning.

ADVICE

The Labour Relations Act says employees have a right to take part in forming and joining a trade union.

An employer is under no legal obligation to pay salaries or wages when no work is done. Employers can ask staff to take their annual paid leave.

It’s possible to fire without warning, depending on how serious the offence is.
