THE FACTS

SIBONISO Khubeka from Thembisa, Tshwane said there was a robbery at Studio 88 in 2015 and he and other employees were blamed for the robbery.

A case was opened with the police but the company hired a private investigator who questioned the staff and did polygraph tests. They were dismissed a month later.

They reported their cases to various CCMA branches and the matter was transferred to Tshwane. They applied for a pro bono lawyer but he never arrived at the final CCMA hearing. They were told they would be informed of the outcome but never received any feedback.

WHAT I DID

The case was sent to Scorpion Legal Protection for professional analysis and advice.

SOLUTION

An arbitration award needs to be issued within 14 days of the hearing at the CCMA.

The outcome of the case can be obtained by calling the CCMA on 086 116 1616. The claimant must provide his ID number, the names of the parties involved and the case number. If the outcome of the case is not favourable, the reader may refer the matter to the Labour Court for review within six weeks.

To report the attorney, Siboniso must complete a complaints form before a Commissioner of Oaths which must be taken to the Law Society in Pretoria or sent by registered mail to Box 1493 Pretoria 0001. The Law Society will investigate and decide whether there was any unethical or improper conduct on the part of the attorney.
