MIYELANI Baloyi from Pimville in Soweto was employed at a bank, and when she was dismissed she took the matter to the CCMA. She signed a settlement with the bank to finalise the matter, but she has now found that she is debarred and cannot get work. She does not know what to do.
WHAT I DID
I spoke to the Financial Sector Conduct Authority to find out what Miyelani can do about the debarment.
SOLUTION
Thobeka Jojozi of the conduct authority advised that a debarred person has 30 days to apply to the authority’s tribunal for the decision to be reconsidered.
Alternatively, the debarred person can wait for the period of debarment to expire and then their name will automatically be removed from the register, provided they were debarred by the authority itself and not by the bank they worked for.
