NTSAKO Nkuna signed up for training with Market Traders, and cancelled due to an alleged contract breach. “The company refuses to process my cancellation and told me I
entered into a contract I can’t cancel.”
WHAT I DID
I contacted Scorpion Legal Protection.
SOLUTION
Said Scorpion: “Since we have a copy of the actual contract, we’ll rely on common law and the Consumer Protection Act, which stipulates parties can give notice of cancellation.
“If there’s a material breach of contract, a client is entitled to give the other party 20 days’ notice to cancel it.
If there was no breach, the supplier can impose cancellation fees, but these must be reasonable and apply if there was no fault on the supplier’s part.
“There’s misrepresentation. Ntsako will rely on Section 14 of the Consumer Protection Act, meaning she’ll give the other party 20 days’ notice to cancel.”
