THE FACTS
Kgabo Mabotja from Koffiefontein, Free State worked for Polokwane Municipality from 2006 until 2008. The municipality promised not to fire him if he became a witness in a fraud case against some employees. This was according to a verbal agreement with their lawyers.
They later dismissed the employees and he heard he would also be dismissed.
After some time, he received a cheque for
R24 000 from his employer. In November 2016, he received a phone call from a company called Octagon Tracing, informing him he needed to claim his money.
WHAT I DID
I spoke to Scorpion Legal Protection for advice regarding Kgabo’s case.
SOLUTION
He was unfairly dismissed and had 30 days to challenge the decision with the CCMA.
If his challenge was late, he can apply for condonation, although his chances of success are slim.
