THE FACTS

ELIZABETH Mtshali of Dawn Park, Ekurhuleni, said she appointed attorneys to assist her with a claim against the Road Accident Fund for her child.

The matter went to court and a curator was appointed to act in the interests of the minor.

An order was issued that the money awarded be placed in a trust, with the minor child as the sole beneficiary. It is now not known where the funds are as the appointed attorneys are not releasing the details to her.

WHAT I DID

I spoke to Scorpion Legal Protection for advice regarding Elizabeth’s problem.

SOLUTION

Elizabeth can contact the Road Accident Fund directly to find out where the money is kept.

If that is unsuccessful, she can go to the high court and give the registrar her case number.

They will be able to provide her with the details of the trust fund as she is the parent of the child. They will then be able to tell her what their rules are in terms of funds they can give her access to. Elizabeth has already reported the attorney to the law society.
