FORMER Isidingo and Scandal! actor Tumisho Masha’s estranged wife is taking him to court . . . AGAIN!

Zozibini Mntongana approached the court to reinstate the assault charges she had filed against him last year.

According to insiders, last month’s move was prompted by Tumisho’s alleged violation of a court order recently following Zozibini’s initial withdrawal of the same charges in November.

Reports of the incident last year suggested that Zozibini had opened a case of assault with intent to do grievous bodily harm.

This was after Tumisho had allegedly assaulted Zozibini and damaged her cellphone.

The actor was arrested, but his estranged wife withdrew the charges.

But a lot has happened since, and Tumisho has allegedly not kept up his end of the bargain – to stop threatening and or intimidating his wife.

In an affidavit seen by the SunTeam this week, Zozibini claimed she’d been threatened over the phone and that the intimidation had started in December.

And because she had reinstated the charges, her complaint was escalated to the National Prosecuting Authority, which issued Tumisho with a summons to appear in the Randburg Magistrates Court on 7 November.

Police spokesperson, Mpho Tshetlhane, confirmed that summons had been issued against Tumisho.

Zozibini’s new statement reads, in part: “I’m a complainant in a case of assault with intent to do grievous bodily harm and malicious damage to property, case number: 423/09/16 opened at Douglasdale SAP in September 2016 against Tumisho Masha.

“The case was referred for mediation in court, which entailed that I’d withdraw the charges against him provided he adhered to the conditions of mediation, which were that he pays for my phone and not commit any other acts of violence against me.”

The 33-year-old also told police she feared for her life. This after Tumisho (42) had allegedly enquired about her whereabouts and stalked her.

“He failed to pay for my phone and has started to harass me. The first incident of harassment was on 9 December. While on the phone with me, he told me he knew everything that happened in my house and knew I was out the night before and dressed in black,” it reads.

“In another incident, I was told by my helper that he inquires about my whereabouts and instructed her to leave the house, while he waits for me to come home. I found him waiting for me in the house upstairs, in the dark, on 5 May. I would like for the charges against him to be reinstated, as I fear for my safety.”

Tumisho confirmed the charges had been reinstated, but said he couldn’t comment because the matter was before the court.

He said: “What I can say is I have no fear. This is just another abuse process from my wife. I’m ready for whatever outcome.”

Asked to comment, Zozibini told the SunTeam this was a private matter.
