The trial into the murder of Bafana Bafana and Orlando Pirates goalkeeper continues at the North Gauteng High Court in Tshwane on Friday, 9 September.
The court proceedings resumed with State Prosecutor Advocate George Baloyi telling the court that the second state witness Sergeant Mlungisi Mthethwa's 2014 pocketbook was unavailable.
This comes after attorney to the first four accused, TT Thobane had the matter postponed overnight on Thursday (8 September) for Mthethwa to bring his pocketbook.
But Baloyi told the court the police's records clerk at Vosloorus police station has deposed an affidavit that the only pocketbooks still remaining are from 2016 onwards.
Thobane said he will accept that but told the court that they will need to get Gladness Khumalo, who is referred as MaKhumalo by Mthethwa to come to court.
He said if the states does not call her, they will have her subpoenaed.
With Mthethwa still under cross-examination, Thobane asked about the hat that was found at the kitchen of the crime scene, which the State alleged belongs to one of the accused.
Mthethwa said MaKhumalo said, the hat belonged to the people who came to attack there, and the hat was on the floor.
Talking about the time contradictions, between first witness Sergeant Thabo Mosia timeline and Mthethwa's, TT Thobane asked what time Mosia arrived on the scene.
Mthethwa said he cannot be exact as to when Sgt Mosia arrived, but adds that when his statement was commissioned, Mosia had arrived.
He said his statement was commissioned at 10pm.
Thobane then informs Mthethwa that Mosia testified that he arrived after midnight.
"When Mosia arrived, he found us in the house. It was not long after Mosia arrived that the team arrived," said Mthethwa.
Thobane tells Mthethwa that he wants to know the family arrived because Mosia testified that he found the family inside the house and put them in a separate room before doing his forensic work.
Which Mthethwa answered by telling the court that:
"It means then that I was not there at the time when he did that," he said.
