WATCH | ‘Zuma is a criminal, but we still love him!'

THE decision to elect Jacob Zuma as a presidential candidate for the uMkhonto Wesizwe party (MK) raises serious questions about the game Msholozi is playing before the general elections on 29 May.  

Zuma cannot ever be president again. His criminal record automatically disqualifies him from contesting according to Section 47 of the Constitution. This section prohibits individuals who have served a prison sentence of 12 months or more for a criminal conviction from being elected to Parliament. But Zuma's eligibility could depend on the specifics of his conviction, sentence, and any potential appeals or legal processes. 

And that's not the only reason he can't be president again. Section 89 of the Constitution concludes: "The President's term of office begins on assuming office and ends upon a vacancy occurring or when the person next elected President assumes office." 

Despite his legal controversies, Zuma still holds political influence and support. 

His candidacy could attract voters who are disillusioned with other parties or who support him personally. 

Zuma failed to cooperate with the Zondo Commission of Inquiry into State Capture.

This led to his conviction of contempt of court in July 2021, resulting in a 15-month prison sentence.

Formation of the MK Party 

Zuma's decision to join and represent the MK Party could be driven by several factors, including a desire to maintain political relevance and influence despite his suspension from the ANC.

Competition 

South Africa's political landscape is characterised by many political parties competing for seats in Parliament and provincial legislatures. 

With over 350 parties participating in the 2024 elections, smaller parties like the MK Party may struggle to gain significant traction and influence. 

Zuma's involvement may increase the party's visibility and attract supporters, but the outcome is not guaranteed.
