THE Special Commercial Crimes Court sitting in Rustenburg has postponed the case of EFF councillor and former North West provincial legislature member, Betty Diale.
The case was postpone to Thursday, 14 December 2023.
Her attorney requested for the adjournment to be able to comment on the media application made by Daily Sun.
The magistrates will then decide whether to grant permission to take photographs after hearing the defence's arguments.
Diale’s attorney has also indicated that they will have the Director of Public Prosecution’s (DPP) rejection of their representations to have charges against her be withdrawn on review.
The state indicated that they will not accept any further delays as the matter has already been postponed several times.

Diale is facing six charges of theft totalling about R700 000, which she allegedly stole from Road Accident Fund (RAF) victims.
Police reports indicate that the Legal Practise Fidelity Fund has received several complaints from RAF claimants whose payments had been paid into Diale’s trust account. The claimants alleged that the money did not reach them after being paid out and subsequently reported the matter to the police for investigation.
Diale worked as an attorney during the alleged commission of the offences between 2009 and 2011 and was charged with six counts of theft in June 2021.
The Legal Practice Council has struck her off the roll, meaning she can no longer practise as an attorney.
