THE Special Investigating Unit (SIU) is considering its legal options following the interim interdict on its investigation against Eastern Cape Premier Oscar Mabuyane.
This after the Bhisho High Court ruled in favour or Mabuyane on Tuesday, 20 June, interdicting the SIU from investigating the qualifications he submitted to Fort Hare University to get into a master's degree course.
In terms of the order, the SIU has been prohibited from enforcing a proclamation which authorises it to investigate allegations of maladministration in the affairs of Fort Hare University in matters relating to Mabuyane.

SIU spokesman Kaizer Kganyago said the unit has noted the court order, adding that the investigation relating to Mabuyane is interdicted pending the court's future findings on the merits of the case regarding the admission into and awarding of a master's degree to the premier.
“The SIU has studied the judgment and is happy that it does not interdict or suspend the Fort Hare University investigation in its entirety. We are also optimistic that we will present our case when part B of this matter is heard,” said Kganyago.
He said the unit was also encouraged by the part of the judgment, which read: “Where there is evidence that implicates unlawful conduct in so far as the master's degree is concerned, there is nothing stopping the SIU from preparing a motivation as it did with the earlier proclamation and request the president to proclaim that the registration for master's degree, too, should be investigated.”
Kganyago said that the SIU would explore all legal options available to it.
