THE accused in Zola Kobe (31)'s murder is out on bail.
Mulimisi Modise (46) was granted bail during his court appearance at the Stilfontein Magistrates Court on Thursday, 10 August.
According to his attorney Ditebogo Kotoane, the suspect has no pending cases, no previous convictions, and no protection orders.
Modise was warned by Magistrate Liezel Kok that his matter is a Schedule 5 case.
During his bail application, Kotoane said his client agreed that he was with the deceased at a local tavern on Friday, 4 August night.
"My client said he was drinking whiskey in a tavern, and while he was drinking with some friends, he went to the toilet. And on his way back, he was told that the deceased drank his whiskey. He then pushed him to the wall," Kotoane said.

The attorney said according to Modise, he later reconciled with the deceased and drank together.
"The deceased kept on falling on the ground because he was drunk, so he was later taken to his home. I was so surprised in the morning when I heard about his death," the suspect's statement read.
Kotoane said Modise's intention in pushing the deceased was not to kill him.
State prosecutor Kele Mochwaisa said the investigating officer's statement has no grounds to oppose bail, so the state is also not going to oppose bail.
Magistrate Kok said the suspect is innocent until proven guilty in court, so he granted the suspect a bail of R1000.
Modise was arrested for murder the after he pushed the deceased to the wall which he hit with the back side of his head.
The incident happened on Friday, 4 August at the local tavern in Khuma.
