THE second accused in the Ben Gumbi murder case, Thabani Gwala, has abandoned his right to apply for bail.
The 29-year-old appeared before Rustenburg Magistrates Court on Tuesday, 5 December.
The case was postponed to 9 January 2024 for him to appear with his co-accused, Sibongiseni Ngubane.
Gwala has appointed a new attorney. He was previously represented by Legal Aid.
He was arrested on 16 November in Joburg in connection with the murder of the famous businessman Gumbi.
The first accused, Sibongiseni (33), was denied bail in October after the state successfully opposed it, and his case was postponed to 9 January for further investigations.
Gumbi (49) was gunned down by two men outside a restaurant in the Rustenburg CBD on 23 August 2023.

The suspects fled the scene in a blue VW Polo car and later abandoned it at the Corner of Helen Joseph and Lourie Streets.
The vehicle was found a few minutes after the incident.
Gumbi’s mother, Magdalene Gumbi, said they have hope in the justice system.
“I can see that the people are doing their best.
“It’s still painful for us as a family. My husband suffered from a stroke and he’s in a hospital because of everything that’s happening. I wonder what the culprit thought by killing our son," she said.
"We want to know who instructed these people and I'm hopeful that those in custody will reveal the truth."
