Sibulelo (39), who is attached to the Bushbuckridge police, appeared in the Mhala Regional Court in Mpumalanga on Monday, 10 October.

He told the court he was acting in self-defence as his life was in danger when Pako (30) pointed a gun at him. Prosecutor Lot Mgiba asked the accused to explain what happened on the day in question.

“We quickly surrounded the house. After knocking on the door and identifying ourselves as the police, we suddenly heard gunshots. I saw the window next to me being opened and the deceased exited naked with a gun in his hand pointed at me.

“Realising that my life was in danger, I shot him. He rose and staggered before falling,” said Sibulelo.

Investigating officer Detective Sergeant Nyiko Nyathi also took the witness stand.

She testified that five officers took position after they arrived at the RDP.

She said she and the accused were standing at the back of the house when they heard gunshots from the front of the house.

“I quickly moved when I saw the deceased jump out of the window with a gun pointing at the accused. The accused then fired shots at him and he fell to the ground,” she said.
