NOT In My Name says they are concerned about the abuse of the insanity plea.  

This comes after the court ordered that the Ekurhuleni serial rapist be sent for mental evaluation.   

Nkosinathi Phakathi, a serial rapist guilty of 90 counts of rape, including 43 counts of kidnapping and three counts of compelling a child to witness a sexual act, will be sent for psychiatric evaluation as per Judge Lesego Makolomakwe's order.  

This comes a day after Angelo Agrizzi received the same order.  

Phakathi appeared in the Pretoria High Court sitting in Palm Ridge Magistrates Court on Friday, 29 September. 

The matter was postponed to 27 November in the Benoni Magistrates Court.  

Not in My Name head of communications, Mo Senne, said their organisation is concerned about the abuse of state resources and the insanity plea.  

“It's our opinion that criminals are aided by the state and its psychiatrists to weaponise psychological concepts and constructs when it is time to account.  

“Phakathi alleges that "voices" told him to rape women and children, with the youngest victim being nine years old,” Mo said.

She said prisons should cater for the criminally insane, and the criteria for psychiatric assessments must be more strict.   

“As it stands, the vicissitudes of justice are influenced by anyone being able to feign or weaponise psychology for mitigation or complete evasion of accountability. 

“If criminals like Phakathi and Agrizzi are capable of managing tenders worth millions and running away after raping women and children, then they're capable of answering for their transgressions,” she said. 

Phakathi terrorised girls and women for nine years in areas east of Benoni, Ekurhuleni.  

He was arrested at the Barcelona section in Etwatwa.  

His rape spree dates back to 2012, with victims aged 12 to their 20s falling victim in Daveyton, Putfontein, Crystal Park and Etwatwa.  

Phakathi has been in a prison hospital since his arrest in March 2022.   

He was shot in the leg as he allegedly fled from the police officers who had come to arrest him.  

The leg has since been amputated.
