Gumbi's 'killer' case postponed

THE Rustenburg Magistrates Court has postponed the murder case of Sibongiseni Ngubane (33) until Monday, 2 October, for a ruling on his bail application.

Ngubane was arrested in Germiston, Ekurhuleni on Tuesday, 12 September for the alleged murder of prominent businessman Ben Gumbi.

The accused's attorney stated that he had no privileged information on the evidence the state wanted to present against bail.

The state rejected this request, pointing out that the defence had enough time to deal with the evidence presented by the investigating officer during his testimony.

The state also argued that Ngubane’s attorney had read an affidavit in court in which he gave reasons for granting him bail.

The accused's defence lawyer argued that his client was a e-hailing driver who was only hired as a driver and knew nothing about the intentions of the other suspects.

However, the prosecution strongly opposed the granting of bail stating that they have enough evidence and a strong case against the accused.

The investigating officer, Patrick Morunwa, pointed out the seriousness of the offence and that the accused's life could be in danger if he was released on bail.

Morunwa highlighted the community’s interest in the matter after video footage of the alleged incident went viral on social media.

The state also urged the court to consider the manner in which the alleged offence was committed.

The deceased's niece, Nosipho Sibeko, said Gumbi was a loving uncle and father who wanted success for his family and community.

"We have lost someone who was passionate about making a difference in people’s lives," she said.

Nosipho said they want the police to put more effort in arresting the other suspects. She emphasised that the family was more interested in knowing the real culprit.

"Our lives have never been the same since the tragedy happened. Our family was left with so much sorrow.”
