THE African Content Movement (ACM) has filed a motion of no confidence against Economic Freedom Fighters (EFF) councillor Chicco Mkhwanazi.

Mkhwanazi is the chairman of the Municipal Public Account Committee (MPAC) in Maluti-a-Phofung Municipality in the Free State.

Maluti-a-Phofung Speaker Mandlenkosi Dlamini confirmed that the motion of no confidence was filed in his office on Monday, 6 November.

ACM Councillor Tumelo Thulo said the motion was due to the failure of the  chairperson and the dysfunctionality of the committee, including the lack of leadership.

"The main role of MPAC members is to advocate for openness, transparency, honesty, integrity, tolerance, respect, equality and fairness. The chairman has failed to promote good governance, transparency, accountability and value for money in the use of municipal resources. Review and evaluate the content of the annual report and make recommendations to council in adopting an oversight report on the Annual Report in terms of Section 127 of the Municipal Finance Management Act (MFMA). Dealing consistently with criminal and disciplinary proceedings," he said.

According to Thulo, the MPAC chairman failed to use the information provided by the audit committee in terms of Section 166 of the MFMA.

"The chairman failed to prepare an annual oversight work plan for each year based on the functions and responsibilities assigned to the MPAC and to ensure that the plan is aligned with all relevant policies and priorities of the administration and to ensure that relevant matters are addressed on the agendas of planned meetings.

"The chairman has failed to table even a single report to council since his appointment as chairman, allowing the financial mismanagement to continue under his absent leadership. His draft reports have been repeatedly rejected for sloppiness and inadequacies. He has not demonstrated that he understands the role of MPAC and the regulations associated with it," Thulo said.

Thulo alleged that the chairman has not bothered to investigate the Maluti-a-Phofung Local Municipality's skyrocketing unauthorised, irregular, useless and wasteful expenditure, which amounts to well over R1,3 billion.

The motion will be discussed at a special council meeting on Thursday, 9 November.
