According to the Children’s Act, a biological father has full parental rights to his children, unless a court orders otherwise.
According to the act, an unmarried, biological father has full parental rights to his child if he:
* Consents or applies to be identified as the child’s father, or pays damages in terms of customary law;
* Contributes or has attempted to contribute to the child’s upbringing for a reasonable period;
* Contributes or has attempted in good faith to contribute towards expenses in connection with the maintenance of the child for a reasonable period.
A father who struggles to maintain their children can apply for a social grant.
Stats SA has reported that 1,3 million (60%) of households have absent fathers and this leads to developmental challenges in education, mental health, labour force and the stability of family formation.
