THE FACTS

ONALENNA Sematle from Ikageng, North West said his uncle, a security guard, was assaulted by one of his superiors in 2005 after being accused of stealing. His employers fired him while he was still in hospital.

He took his bosses to the CCMA who, in turn, laid criminal charges against him. For his CCMA case, he was to be assisted by Nehawu, but their representative did not appear.

The matter was postponed and during the postponement he was convicted of theft and sentenced to a year in prison. Nehawu failed to inform the CCMA that Onalenna’s uncle was in prison and would not be able to attend the case.

WHAT I DID

I advised Onalenna.

SOLUTION

You only have three years to institute legal action against someone for money. If he has not claimed from his provident fund, he can check if there is any money due to him.
