THE FACTS
THERESA LESUFI from Attridgeville, Pretoria, said she referred a case of unfair dismissal to the CCMA in 2016.
As the employer didn’t attend the hearing, she was given a default award that included compensation.
She started the process of having the award enforced and took it to the sheriff who, after some time, advised her that the employer told him the goods on their premises belonged to another company. Theresa wants to know what she can do to get the money due to her.
WHAT I DID
I spoke to Scorpion Legal Protection for professional legal advice for Theresa.
SOLUTION
Scorpion’s legal advisor advised that Theresa should ask for proof from the sheriff that the goods did not belong to her former employer.
The sheriff can attach goods on the employer’s premises and the new owner must submit an affidavit to the sheriff for the goods to be released.
If the sheriff is not able to provide this proof and fails to attach the goods then he should be reported to the board of sheriffs.
