THABISO Molebala from the Joburg CBD worked for Incredible Solutions as a branch manager.
He’d been with them from 2008 until 2017, when liquidators arrived to tell them the company was closing down.
They promised to pay them their severance packages, but that wasn’t done. He later found out it hadn’t closed, and that they’d appointed a new manager instead.
WHAT I DID
I spoke to the Department of Labour to ask for advice.
SOLUTION
Spokesman Makhosonke Buthelezi said in 2017 Thabiso had to lodge a dispute with the CCMA for unfair retrenchment. He had 30 days from the retrenchment date to lodge it. He now may apply for condonation for the late referral of the matter and must show good reason for the delay.
