THE FACTS

Diane Mokgorosi from Kagiso in Mogale City said she has been married for more than 10 years but is unhappy.

While she has been considering divorce, she fears her husband will not consent to it. She also asked if she can separate from him.

ADVICE

You don’t need permission from the other spouse to get divorced.

You only need to satisfy the court that grounds for divorce exist.

To start the divorce process, there are procedures, by law, that need to be followed.

You need to issue a summons that will serve to notify the other spouse of your intention. According to the law, even if you separate, you are still legally married.
