Precious Khanyile from Dobsonville, Soweto, said she was involved in an accident. She appointed an attorney to represent her at the Road Accident Fund.
She said the fund made a payment of up to R1 million.
The money is with the attorney. Precious was only paid a portion of the money. Now, the attorney refuses to pay her the balance.
ADVICE
When you have an accident claim it can either be a direct claim where you submit the claim yourself or it can be a represented claim where you appoint an attorney to represent you at the RAF.
When a claim is represented, this means the fund will speak to the attorney appointed directly and when an offer is made and accepted by the attorney, the fund pays through your attorney once payment has been made.
You can only contact the attorney for payment. The fund is not part of the transaction.
Precious should report the attorney to the law society or the legal practitioners’ council.
