THE FACTS

CHARLES Mokgolobotho and Elliot Ngalo from Boksburg said the Germiston city council undertook to transfer members to Ekurhuleni Water Care Company in 1993, with the same terms and conditions of employment and subject to the same benefits.

But the members subsequently discovered that the company had employed them under new conditions.

A case was instituted against the council and the judge ruled in their favour. Payments were made to other members, but Charles and Elliot were among those who weren’t paid. They have been struggling to get their outstanding pension money since then.

WHAT I DID

I spoke to City of Ekurhuleni spokesman, Themba Gadebe.

SOLUTION

Gadebe said according to the information they have, when employees were transferred to Erwat they claimed their pension from the Transvaal pension fund. That fund no longer existed but the documents indicate that the money they received was in full and final settlement of their case.
