THE FACTS

SELLO Sefoka from Ledig in Rustenburg, North West, said that his parents were married in community of property.

But when they separated his father gave the marital home to his nephews without Sello’s mum knowing.

Sello said he now wants the house back for his mum’s sake.

THE ADVICE

Sello’s mum must start divorce proceedings and claim her 50% share of the property.

Since the property has already been given to someone else, the magistrate will most likely order that a liquidator assess the value of the property so that Sello’s mum can be given her share in cash.
