ELLEN Nquma from Phulaneng Village, Tzaneen, Limpopo said she and her husband agreed to agreed to a debt review with Debt Expert in 2014. After she and her husband signed the agreement, creditors still demanded money. She contacted the company to find out why they weren’t paying her debts, as they debited her account every month. The company told her to pay her creditors up to the point where she was handed over. She managed to pay all her debts except one, but her record shows she is still under review. She wants to remove this from her record.

SOLUTION
The attorney at Scorpion Legal advised that Ellen should lodge a complaint with the NCR (National Credit Regulator) he said; “Some of these Debt Counsellors prepare all the necessary documents, set a date to go to court, but then do not attend court in order to avoid the legal costs and thus do not complete the process.”The challenge is that at this point the Debt Review is already appearing on the credit record. He advised that, “The correct process would mean that the court grants an Order that the person be placed under Debt Review and then when the debts are paid off, the court will grant a Rescission of the Debt Review.” In Ellen’s case, she can send the paid up letters for the debts that she has paid off to the Credit Bureaus for them to be updated and the complaint at the NCR will address the process that the Debt Review company took, in her complaint, she should also include that she needs the Debt Review removed from her credit profile.
