THE FACTS
DINGAKA Skosana from Phuthaditjhaba, Free State, said he was working for the municipality as a caretaker at Intabazwe Cemetery.
He worked overtime for many months, but was not paid for overtime.
He said tried to sort out the matter, but without success.
THE ADVICE
Working time, including overtime, is regulated by the Basic Condition of Employment Act. The act states that the employer should compensate workers for overtime according to the prescribed rate in the act.
If the employer doesn’t pay, Dingaka can report the matter to his nearest Department of Employment and Labour office.
