THE FACTS

CYNTHIA NDLOVU from Dingleton in Northern Cape claims her child was given corporal punishment by teachers at school which resulted in ugly bruises.

She said this was reported to the Department of Education and an inspector told her that one teacher had been fined a month’s salary.

She was also allegedly told the department would have to pay the child’s medical expenses. Since then Cynthia has not received further correspondence, so she. She also lodged a complaint against the deputy principal of the school, whom she claimed offered her a bribe.She said she didn’t know what happened with the complaint wrote to Sun Defender.

WHAT I DID

I contacted Scorpion Legal Protection for professional legal advice.

SOLUTION

Scorpion’s legal adviser saidstated that corporal punishment was abolished in South African schools in 1997 and is now a criminal offence. Cynthia has three options:
- She can open a case against the teachers concerned;

- She can also sue the department for general damages; ands, being the pain and suffering of her child, as well as special damages which would be the child’s medical expenses.

- She can also lodge a complaint against the education department with the Public Protector.Her complaint must include all proof that she has in writing as well as the names of the people that she spoke to at the department.

When suing the department, the process needs to be started within six months of the event. Our reader will have to appoint an attorney to help her with this.
