THE FACTS

VALENTINE Cadena from Polokwane, Limpopo, said he won his case that he had referred to the CCMA.

His employer was ordered to pay him his salary of eight months.

But instead of paying the money, the employer sent him a letter asking that they only pay him only three months salary.

The other issue is that Valentine went to the Department of Employment and Labour to claim his UIF. He found that he had not been registered even though his pay slip showed UIF deductions.

THE ADVICE

Valentine needs to go back to the CCMA to enforce the arbitration award.

The UIF issues must be investigated by the Department of Employment and Labour. He has to open a case against his former employer and the department will appoint a labour inspector to attend to the complaint. At the end of the investigation, the inspector will grant a compliance order regarding the UIF payment due to him.
