FORMER Eskom legal head Suzanne Daniels is living in fear after giving evidence at the Zondo Commission.

She said her daughter fled to live overseas due to threats they received almost daily.

Speaking at the commission earlier today, she said: “Since making my disclosure, I’ve been maligned and attacked as a disgruntled opportunist seeking some form of redemption.”

Daniels said the people attacking her with beneficiaries of state capture. She said when she testified, she admitted her own wrongdoing.

“I may not be able to work in my profession again,” she said.

Daniels accused the commission of treating her unfairly, compared to other witnesses.

She said Deputy Chief Justice Raymond Zondo asked her pointed questions and appeared to have judged her before her appearance.

Koko was used by the Guptas through their lieutenant Salim Essa to loot Eskom.

But Zondo dismissed the claims and said he was fair according to how he understood the concept.

He said anyone was free to criticise the commission.

“We’re not going to try and follow anybody’s programme. We’ll only follow the commission’s programme on how we do things,” said Zondo.

Daniels told the inquiry the Eskom board took part in the acquisition of Optimum Coal Mine by Gupta company, Tegeta. She said Tegeta didn’t have the R2,2 billion asking price for the mine.

According to Daniels, in December 2015 the Eskom board took a decision to give Tegeta R1,68 billion as prepayment for a coal order.

Evidence shows Tegeta used that money to show business rescue practitioners it had funds.

Daniels said she became involved in the discussion in early December after then head of generation, Matshela Koko, asked her to attend a meeting with Tegeta and Optimum.

She said Koko later asked her to draft a letter to the mineral resources department asking for assistance. She did not specify what kind of assistance.

She said Eskom board chairman Ben Ngubane on 7 December phoned her and told her to convene a board meeting. But Ngubane told the commission Daniels called the meeting, according to a letter sent by Koko.

She said Koko was used by the Guptas through their lieutenant Salim Essa to loot Eskom.

“Koko was a conduit for Essa and he implemented Gupta instructions at Eskom,” said Daniels.
