THE National Prosecuting Authority is confident it will nail ANC Councillor Andile Lungisa.
Lungisa approached the Grahamstowna High Court on Wednesday in a bid to have his assault sentence overturned.
Last year, the Port Elizabeth Magistrates Court found Lungisa guilty of smashing a glass jug over DA Councillor Rano Kayser’s head during a council meeting in 2016.
Lungisa was given a three-year sentence, with one year suspended for five years.
Magistrate Morne Cannon said the matter was not politically motivated but was a criminal case.
She labelled Lungisa a poor witness who tailored his evidence.
NPA spokesman Tsepo Ndwalaza said: “Both the state and the defence presented their arguments before Judge Judith Roberson and acting judge Feziwe Renqe of the Grahamstown High Court.
“The judgment has been reserved. We will be informed by the court when the ruling is handed down, but we believe our case was finalised when he was sentenced,” he said
“The NPA did a good job and we maintain that the merits of the magistrates court were fair. We believe the high court will not come to a different conclusion.”
Lungisa is out on R10 000 bail.
