IT’S hardly a year since he lost his acting job on Generations.
And now former Generations actor, Thamsanqa Mngqolo, faces spiralling debt.
Thami, who used to play Senzo on the soapie, was taken to court for defaulting on his car payment.
According to court papers in possession of Sunday Sun, Thami owes R17 471,44.
The court papers show Thami owes FNB R59 538, including interest. And this has put him in danger with the repo man.
The bank applied at the South Gauteng High Court in Joburg to have the car repossessed.
But Thami tried to put up a brave fight against the bank’s order to repossess the car. In April he informed the court through his lawyers, Mzamo Attorneys, that he intended to defend the case.
In May the bank applied for a summary judgment against the TV star. It asked the court to order him to return the car and also to cancel the agreement.
But Thami’s efforts to fight the bank were in vain as Judge Matojane ordered that the 2010 Audi A3 be repossessed. The judge spared him from paying damages when he postponed the bank’s application. But he ordered that Thami pays the cost of the application.
The actor was supposed to pay a monthly instalment of R4 164,78 but started defaulting last year.
The bank’s legal representative, Fahim Ebrahim, argued that Thami’s action to defend the case was done so to delay proceedings.
“In my opinion, the respondent doesn’t have bona fide defence to the action and has delivered his notice to defend the action solely for the purpose of delay,” said Ebrahim in his affidavit.
The bank argued Thami was in breach of the agreement and failed to approach it or the court when he couldn’t pay.
Yesterday Thami confirmed he is aware of the case and said: “I only came to know about the case late and when I tried to fight it, it was too late.”
He said he gave the car to his brother over a year ago and was not aware he was no longer paying.
“I was very shocked when I got the court papers because I thought my brother was paying for it. I’ve been driving an A5 for more than a year, so the A3 is no longer in my possession.”
He added that the case is with his lawyer and hopes a settlement will be reached soon.
