THE FACTS
XOLANI Ntshokotha from Doornkop, Soweto was working for West Rand Coach Works when he resigned to pursue his own business interests.
When he claimed his provident fund money, he was told it could not be paid because his employer hadn’t paid the fund in November and December last year.
On his payslips it shows the deductions were made. He was not able to get answers from his employer and so he came to SunDefender for assistance.
WHAT I DID
I asked Scorpion Legal Protection for guidance regarding the case.
SOLUTION
Scorpion Legal advised Xolani to take the matter to the pension fund adjudicator, who will determine whether there were deductions made from his salary.
The adjudicator can reach a conclusion and force the employer to make the two payments.
The adjudicator may also instruct the fund to process the claim if he believes it would be unjust for the employee not to receive payment.
