THE FACTS

Jacob Sacolo from Kagiso, Mogale City, in Gauteng has been working for a construction company from 2001 but, according to him, he was not registered with the Department of Labour and has never received any official documents from his employer.

WHAT I DID

I spoke to Scorpion Legal Protection for advice about Jacob’s case.

SOLUTION

The employer is bound to register an employee as long as the employee works for more than 24 hours per month. What a worker can do is produce evidence of payment such as payslips or bank statements to lay a complaint at the Department of Labour, and the department will investigate.

This includes sending letters and inspectors to check the employer. If the employer does not comply, the department will proceed to the
labour court for a ruling.
