THE FACTS

PHILLIP Ndlovu from Orlando West, Soweto said when he was dismissed from Amalgamated Projects, he challenged it at the CCMA.

He won the case but the employer refused to pay him as ordered by the court.

A judicial order was granted but the employer still did not co-operate.

The sheriff made several visits to the employer’s house to seize goods, but the employer was never there.

Phillip came to the SunDefender to ask for legal assistance.

SOLUTION

The sheriff has the power to seize property by force and sell it.

Hiding from the sheriff after being informed of the attachment is a crime.

The sheriff will go to court to get an order. A report should be made in the form of an affidavit for the court, which will give the sheriff the right to remove the property.
